These verses do not settle the bill: the first is ritual purity law for ancient Israel that assumes the male/female pair without defining sex biologically or addressing congenital anomaly, and the second concerns incest within a family, not strangers in a locker room. Neither speaks to gender identity, intersex conditions, school and campus facilities, agency rulemaking, or what penalty or exception a modern state should attach.
